Help, I need your advice. We are going to lay off a person at the end of the month. Besides the Cobra deal, is there anything else I need to know or do? I assume there is no problem telling this person that they have to clear out their area before the end of that day.

Well it depends, do you offer a 401k plan and is that person enrolled? If so, they will need information about withdrawing their money.

Depending on your state, you might have to give them a separation notice.

You also want to make sure to get back anything that might be company property such as keys, cell phones, pagers, etc...

Other than that the person will probably want to know when they will receive their last pay check and whether they receive any vacation time, etc.

You probably didn't intend it the way it comes across but telling someone to clear out their area by the end of the day sounds a bit cold. Yes, when a layoff occurs it can be expected that the person can be gone, presumably with their belongings. Just remember that HOW a person is laid off, the way they are treated, is important. some people want to get back at their employer through lawsuits or other means, just because they were treated poorly when the separation took place.

The employee should settle all financial matters (outstanding expense vouchers, etc.) before leaving. Also, if the employee has a government security clearance and worked on classified government work, he should be debriefed by your security personnel. This may not apply since its a layoff, but under normal circumstances we routinely tell employees if they are not recommended for reemployment.
