Scenario: 1) married employee terminates employment; 2) Spouse is in early 70s and covered for Medicare medical coverage; 3)Notwithstanding item 2), because COBRA appears to not provide language excluding the spouse who is covered by Medicare, said spouse is entitled to elect COBRA.

Correct. Your plan may contain language that indicates that Medicare is the primary payer, but the opportunity to elect COBRA should be given.
