H 1-B Visa Transfers

We had a candidate accept employement with us (signed offer letter) for whom we then initiated his H1-B Transfer.  We set his start date and he indicated when he recieved notification that the transfer had gone through he would give notice to his current employer.  When that happened, his current employer convinced him to stay on and he recinded his acceptance of our offer.  I know that legally, he cannot pay for the application fees for his Visa transfer, but does anyone know if we can go after him for the legal fees we incurred on his behalf to transfer his Visa since he never actually worked for us?
